These Conditions regulate the legal relationship arising from the contracting processes formalized by customers through the website https://winkle.shop/ (hereinafter “web” or “winkle.shop”) through the page, through our sales representatives by telephone, or Whatsapp.
These general terms and conditions of sale shall govern the purchase of any product listed on our website.
The offer of products on the website is aimed at companies/professionals, or individuals.
Definition of consumer (Article 3.1 Law 4/2022 of 25 February):
For the purposes of this law, and without prejudice to the express provisions of its third and fourth books, consumers or users are natural persons acting for a purpose unrelated to their trade, business, trade, or profession.
For the purposes of this rule, consumers are also legal persons and unincorporated entities acting for non-profit purposes in a field outside a trade or business activity.
In all other cases, they are considered to be professionals or companies.
Each purchase transaction is governed by the provisions of the TRLGDCU, Law 34/2002, of July 11, 2002, on Information Society Services and Electronic Commerce and other applicable regulations, as well as by these conditions of sale, published in the Conditions of Sale link on the Website. Unless otherwise indicated, the Customer may make the purchase transaction in the same language in which these conditions of sale are written.
The period of validity of the offer and the price of the Products will correspond to the time during which they remain published on the Website, so the company reserves the right to modify these conditions of sale.
The Customer, by sending his order, unconditionally accepts and undertakes to respect these conditions of sale.
Customers expressly and unreservedly accept these conditions of sale, in the version published by WINKLE, at the time the customer places his order. Therefore, the Customer agrees to carefully read the conditions of sale, each time you proceed to the purchase of any product, since they may have been subject to change since the last time you accessed them.
By means of this acceptance, the Client confirms that:
Prices and rates applicable to the purchase by the Customer of the products will be those listed on the Website at the time the Customer accesses the specific service and proceeds to initiate the purchase process.
WINKLE reserves the right to change the prices of the products published on the Website mentioned above when it deems appropriate and make it visible on the Website. All materials included on the Website (including but not limited to all images, text, trademarks, logos, or other distinctive signs) belong to WINKLE and are protected as works subject to intellectual or industrial property rights.
We shall not be liable for any failure or delay in the performance of any of our obligations under an Agreement caused by events beyond our reasonable control (“Force Majeure Event”). Force Majeure Causes shall include any act, event, default, omission or accident beyond our reasonable control.
All orders are subject to our acceptance. Within 48 hours after placing the order, we will send by e-mail our confirmation of the order placed (hereinafter referred to as “Order Confirmation”), provided that the Customer has provided us with his e-mail address in his personal data form. The Order Confirmation will include confirmation of the Customer’s prior express consent and will inform the Customer of the loss of the right of withdrawal, where applicable.
In the exceptional circumstance in which we could not send any of the products of your order, we would proceed to notify you of this circumstance by e-mail. In case of unavailability of a substitute, we will deduct the product from your order and proceed with the shipment, as well as with the reimbursement of the product not shipped.
The deadline to cancel or modify an order ends at the moment when the order status becomes “Shipped”. From that moment the order will have been transferred to the carrier for shipment, and the purchase will have become a contract of sale to which both parties are subject to compliance, the user as receiver of the goods, and the Web as seller, with the conditions of shipping and service contained in these conditions of use.
In the case of modifications to the order, it may result in a modification of the total amount, which is subject to an additional charge of shipping costs in the case of not reaching the stipulated minimum, as well as the elimination of such costs if the total amount is equal to or greater than the minimum indicated on the web.
In the contracting process the User will accept the total price when he/she clicks on the “Pay” button. In the case of telephone orders, the User will accept the price when he/she confirms the order with the corresponding salesperson.
Product prices may vary, but will not affect in any case orders to which the Order Confirmation had already been sent. WINKLE reserves the right to charge the order from the Order Confirmation.
The selling prices of the Products indicated on the Website are shown inclusive of taxes. Winkle serves both national and international territory, for territory other than national territory, please consult the price for the entire order.
You can choose between several payment methods:
WINKLE serves products in national and international territory.
WINKLE guarantees delivery of your order in the time indicated, depending on the geographical area or the service chosen, provided that the products are in stock. The shipping cost varies depending on the transport service chosen and the destination location and can be consulted at any time during the purchase process on the website and in any case by contacting our sales representatives.
Orders received on Saturdays, Sundays, and holidays will be considered received on the first working day following the same.
If the Products are not in stock, that circumstance will be shown on the Website and the Customer will not be able to place his order until the Products are in stock and available for shipment.
In the event that a product is out of stock, WINKLE will notify the customer as soon as possible, giving the option of refund of payment or modification of the order.

The delivery time and the corresponding costs will depend on the availability of the Product, the shipping methods, the geographical area and the courier company chosen.
For free shipments, please consult with the assigned sales representative, depending on the volume of the order.
The risk of loss or damage to the goods is transferred to the customer from the time of delivery to the customer’s home. WINKLE is NOT responsible under any circumstances for damage caused by misuse of the goods.
WINKLE, reserves ownership of the product sold until the price has not been paid in full.

The transport agencies have pre-fixed transport routes and we cannot control the specific time when your order will be delivered.
We remind you of the legal obligation of the recipient (Article 25 and following Law 15/2009, of November 11, of the contract of land transport of goods), to check the goods at the time of delivery, and in case of visible defects never sign the goods as compliant, but make immediate complaint to the carrier by written note on the delivery note of the carrier (keep a copy).
In case of hidden damage inside the package, make the claim within a period not exceeding 48 hours, contacting WINKLE (claims made later will not be valid). If the goods have been damaged during transport to the point of being unusable, the recipient is not obliged to accept it, and in any case, must inform WINKLE immediately.
If for reasons not attributable to WINKLE or the shipping agency, the order is refused by the customer, WINKLE reserves the right to claim from the customer the shipping costs for standard shipping. The payment of these costs will be made either by debiting the credit card with which the purchase was made or by any other means subsequently agreed with the customer.
You have 14 natural days from the day the package was delivered to the buyer, to return the products purchased. It is not necessary to give any reason. To do so, it is necessary to comply with the following requirements:
Send communication of withdrawal to WINKLE by email or telephone, always within 14 days from receipt and filling in the link for this purpose.
Return the products in the condition in which you received them, without signs of use or damaged packaging, otherwise they will suffer a depreciation when assessing the refund. In the case of receiving the damaged package, DO NOT accept it or put a claim to transport, reject the delivery note and keep it for your claim, likewise, communicate it immediately to WINKLE NOT throw away the packaging until after 14 days.
IMPORTANT: The products are packed in a sealed protector, which must be intact to proceed with the return.
No cancellation is allowed for customized products. Or manufactured specifically upon request.
Once received the package at our facilities, always attaching the invoice and delivery note, we will check that all products meet the above conditions, then you will be refunded within a period not exceeding 14 working days in the same way that the payment was made.
In case of requesting another form of collection of the shipment or refund of the amount, the reimbursement may vary.

Like any other 3D filament, PLA has a shelf life of approximately 1 year, once it has been removed from its vacuum packaging. Next, we will name a series of tips to keep the 3d filament in good condition and to be able to extend its useful life:
All products marketed by WINKLE comply with the Consolidated Text of the General Law for the Protection of Consumers and Users RDL 1/2007 of November 16; Law 4/2022 of February 25 for the protection of consumers and users. For all matters not provided for in such regulations, to the specific provisions of the Spanish Civil Code that are applicable to these issues.
As a general rule, the warranty is 3 years for private consumers and 6 months for professionals and companies that integrate them in the production process, i.e. business or professional activities.
The warranty covers all products against possible manufacturing defects. It does not cover breakage and damage caused by abuse or misuse; WINKLE reserves the right to verify misuse or improper handling.
If you discover any defect during the warranty period of a product you must notify us in writing to WINKLE as soon as possible (maximum two weeks from the appearance of the problem) and preferably within the first six months of use from receipt of order. You must provide us with your invoice, reference and name of the affected item and a detailed description of the problem, if you wish you can add photographs to help describe the problem.
However, warranty periods may vary depending on the type of items, manufacturers and promotions existing at the time of purchase, please consult the existing conditions in the article in which you are interested before making the purchase, if you have any questions you can send an email to WINKLE and we will clarify all your doubts.
When a good is in the warranty period and a defect arises, the customer may choose between repair or replacement of this.
If the product is not in conformity, the WINKLE customer service team will request a series of data to the consumer and user. Once studied, the procedure may consist of the collection of the non-compliant product and sending another replacement, always after the decision of the customer service department.
The resolution will not proceed when the lack of conformity is of minor importance.
The invoice and delivery note must always be presented in order to exercise the product warranty.

The customer must communicate the return to WINKLE and then send the complete product with all its accessories, in perfect conditions of use and in its original packaging, enclosing a copy of the invoice or delivery note, the shipping cost will be agreed with the quality department, depending on the assessment of the reason.

The customer will keep the complete product, preferably in the box/bag in which he received the order (In case of sending the product on your own, identify with the label on the outside the order number and your name). Orders with stickers or writing on the product itself will not be accepted.
Shipment of the package:
